Upstate NY Salaried Exempt Employees Must Earn at Least $1,065 a Week Until December 31, 2023in Business and at Work

Once again, a non-profit near and dear to my heart was in the process of hiring a management-level salaried exempt employee with a 40-hour weekly work schedule paying $800.00 a week.

However, in the great state of New York, in the upstate region where I’m based, the current minimum exempt salaried weekly salary level until December 31, 2023 is $1,065 a week for private sector employees – for-profit and non-profit. (The minimum exempt salaried weekly salary level is always 75 times the current minimum wage. When the minimum wage rises on January 1, 2024 in upstate NY to $15 an hour, for example, the new minimum salaried exempt salary level for upstate NY will also rise to $1,125 a week.)

When the pay of an exempt salaried employee – whether they have a part-time schedule or a full-time schedule – is less than $1,065 a week, they must be paid on an hourly nonexempt basis – or in the example above, $20 an hour for a 40-hour weekly work schedule.  And any hours worked over 40 hours a week must be paid at the rate of 1.5 times the hourly rate – or as in the example above, $30 an hour for any hours worked over 40 hours weekly.
