(Updated as of Jan. 1, 2024) NYS Upstate Part-Time Exempt Employees Must Earn at Least $1,125.00 a Week in Business and at Work

A non-profit near and dear to my heart was in the process of hiring a part-time professional employee with a 20-hour weekly work schedule paying $400.00 a week. From their (initial) perspective, “professional” = “salaried exempt.”

However, upstate in the great state of New York, the new minimum exempt weekly salary level effective January 1, 2024 is $1,125.00 a week.

When the pay of an employee based in upstate New York – whether they have a part-time schedule or a full-time schedule – is less than $1,125.00 a week, they must be paid on an hourly nonexempt basis – or in the example above, $20 an hour for a 20-hour weekly work schedule.  And any hours worked over 40 hours a week must be paid at the rate of 1.5 times the hourly rate – or as in the example above, $30 an hour for any hours worked over 40 hours.
